Frequently Asked Questions About Scaffolding Accident Claims In New York
The primary difference between the two recovery options is the type of compensation available. Workers’ compensation usually only covers medical expenses, a portion of your lost wages and wrongful death compensation. Under Labor Law 240, you also have the right to recover compensation for emotional distress and pain and suffering after a scaffolding accident.
Although New York imposes a three-year limit on filing a personal injury lawsuit and a two-year limit on wrongful death claims, work accidents are subject to additional timing rules. You must notify your supervisor of the accident as soon as possible—but generally within 30 days—of the scaffolding accident. After you provide this notice, you have a one-year period to file for workers’ compensation. There’s also a seven-day waiting period before you can receive workers’ compensation benefits. Once seven days have passed, you receive benefits from day one (retroactively).
